Terms and Conditions of Use and Service

Welcome to 360 Web Agency (‘the agency’, ‘we’). These terms govern the use of our website https://360webagency.com and all services provided by 360 Web Agency. By visiting our website or using our services, you agree to be bound by these terms.

1. Services

360 Web Agency provides professional services including, but not limited to:

• website development;
• mobile app development;
• UI/UX design;
• software engineering;
• IT consulting;
• website and app maintenance;
• technical support.

We reserve the right to modify, suspend or discontinue any service at any time.

2. Client obligations

The client undertakes to:

• provide accurate and complete project requirements;
• supply the necessary content, access and materials on time;
• review and approve deliverables within the agreed timeframes;
• ensure that the content supplied does not infringe applicable law or the rights of third parties.

3. Intellectual property

Unless otherwise agreed in writing:

• 360 Web Agency retains ownership of all pre-existing proprietary tools, frameworks, libraries, methods and technologies;
• upon full payment, the client becomes the owner of the final deliverables created specifically for their project;
• third-party software, plugins, frameworks and licences remain subject to their own licence terms.

4. Payments

Payment terms are set out in each project contract or invoice. Late or non-payment may result in:

• suspension of services;
• postponement of project delivery;
• removal of hosted resources, to the extent permitted by law.

Unless otherwise agreed in writing, amounts paid are non-refundable.

5. Confidentiality

Both parties undertake to keep confidential all non-public commercial, technical and financial information exchanged in the course of their collaboration. This obligation continues after the business relationship ends.

6. Limitation of liability

To the fullest extent permitted by law:

• services are provided ‘as is’ and ‘as available’;
• 360 Web Agency shall not be liable for any indirect, incidental, special, consequential or punitive damages;
• our total liability shall not exceed the amount paid by the client for the service concerned.

7. Third-party services

Our services may rely on third-party platforms: hosting providers, APIs, payment providers, analytics tools and software publishers. We are not responsible for the availability, security or performance of these third-party services.

8. Termination

Either party may terminate a project or service contract by giving written notice. In the event of termination:

• outstanding invoices become immediately due;
• work carried out up to the termination date remains payable;
• access to the services may be discontinued.

9. Governing law and jurisdiction

These terms are governed by Swiss law. Any dispute arising from these terms falls under the exclusive jurisdiction of the competent courts in Switzerland.

10. Changes to these terms

We may update these terms from time to time. The updated version will be published on this page with a new effective date.
